City mayor apologizes to Good Samaritan who heeded call of nature

Joshua Burks stopped his car along a Fairbanks road early one morning in January to help a man who was hurt in a car wreck. At the request of police, Burks remained on the scene for at least a half-hour, despite an urgent need to use a rest room. When he couldn't wait any longer, he took action, and his relationship with the police went into the ditch, reports Dermot Cole in the Fairbanks Daily News-Miner.

Proving that no good deed goes unpunished, [Burks] wound up being handcuffed and taken to jail ... charged with urinating in public. It was after 1 a.m., remember, and there are not exactly a lot of bathrooms on Phillips Field Road.

[Fairbanks Mayor Jerry] Cleworth said he and Police Chief Laren Zager agree that this arrest should never have happened. Burks will pay no fines and the charges have been dropped.

"We want to encourage good Samaritans," Cleworth said. He said the arrest was the action of an "overzealous" officer.
